1. Service Description

NOX AI ("we," "us," "our") provides AI-powered website generation, hosting, and management services for local businesses. Our platform generates custom websites based on business briefs provided by our clients ("you," "your").

2. Payment Terms

Services are billed as follows:

• Setup Fee: A one-time fee is charged upon website generation and delivery. Amount varies by plan selected.
• Monthly Hosting: Recurring monthly hosting and maintenance fees are billed on the same date each month.
• Agency Plans: Flat monthly rate billed on the same date each month.

All payments are processed through Stripe. Prices are in USD and do not include applicable taxes.

3. Refund Policy

Setup fees are non-refundable after website delivery. If we are unable to deliver a satisfactory website, we will issue a full refund of the setup fee. Monthly hosting fees are non-refundable for the current billing period but you may cancel to prevent future charges.

4. Client Responsibilities

• Provide accurate business information for website generation.
• Review and approve generated websites in a timely manner.
• Ensure all content provided to us does not infringe on third-party rights.
• Maintain the confidentiality of portal login credentials.
• Comply with all applicable laws regarding their business and website content.

5. NOX AI Responsibilities

• Generate professional, functional websites based on provided briefs.
• Host websites on Cloudflare's global network with 99.9% uptime target.
• Process change requests within the timeframes specified by the selected plan.
• Maintain the security of client data and website infrastructure.
• Provide SSL certificates and basic security measures for all hosted sites.

6. Termination

Either party may terminate service with 30 days written notice. Upon termination:

• Hosting will remain active through the end of the current billing period.
• Website files can be provided to the client upon request.
• No refund will be issued for the remaining portion of any prepaid period.

7. Limitation of Liability

NOX AI's total liability for any claim arising from or related to our services shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of data.

8. Changes to Terms

We may update these terms from time to time. We will notify active clients of material changes via email. Continued use of our services after changes constitutes acceptance of the updated terms.
